Uttarakhand Real Estate (Regulation and Development) Act

The Uttarakhand Real Estate (Regulation and Development) Act, 2016 (hereafter referred to as the Uttarakhand RE Act) aligns the states realestate sector with the model legislation introduced by the Parliament of India the Real Estate (Regulation and Development) Act, 2016 (RERA). Its principal aim is to bring transparency, accountability and efficiency to the realestate market, protecting the interests of homebuyers while promoting a disciplined environment for developers.

2. Core Objectives

  • Establish a competent Real Estate Regulatory Authority (RERA) for Uttarakhand.
  • Mandate registration of all realestate projects and agents.
  • Ensure timely delivery of projects and truthful advertising.
  • Create a simple, fast, and affordable grievance redressal mechanism.
  • Promote a levelplaying field for developers, preventing unfair practices.

3. Key Definitions

4. Regulatory Framework

The Uttarakhand Real Estate Regulatory Authority (URERA) is a statutory body constituted under the Act. It consists of:

  • The State Secretary (Housing) Chairperson
  • One senior bureaucrat from the Department of Urban Development
  • Three independent members appointed by the Governor
  • One representative of the realestate sector (developers)
  • One representative of homebuyer associations

URERAs responsibilities encompass registration, monitoring compliance, issuing orders, and adjudicating disputes. It operates through three tiers:

  • State Authority overall policy and supervision.
  • Division/Regional Offices handle registrations and daytoday matters.
  • Adjudicating Officers empowered to decide specific disputes and levy penalties.

5. Project & Agent Registration Process

5.1 Project Registration

  1. Application Submission Developer files Form 1 online with details of the project, land title, approvals, and proposed completion date.
  2. Deposit of 1% of the total estimated project cost as security.
  3. Verification URERA verifies land ownership, approvals from local bodies, and compliance with zoning laws.
  4. Grant of Registration If all conditions are satisfied, a unique registration number is issued and the project is listed on the URERA portal.

5.2 RealEstate Agent Registration

  1. Submission of Form 2 with identity proof, PAN, and a minimum bank guarantee of INR 20,000.
  2. Payment of the prescribed fee (currently INR 10,000).
  3. Issuance of a registration certificate valid for three years, renewable on compliance.

6. Dispute Resolution Mechanism

The Act provides a threestage approach:

  1. Conciliation A conciliation officer is appointed within 30 days of a complaint. The aim is an amicable settlement.
  2. Adjudication If conciliation fails, the matter proceeds to the adjudicating officer who can order specific performance, refund, or compensation.
  3. Appellate Tribunal Parties dissatisfied with the adjudicating officers order may appeal to the State Appellate Tribunal within 60 days.

Crucially, the Act mandates that developers cannot withhold possession for more than 30 days after the completion certificate is issued; otherwise, they face daily penalties of 0.1% of the project cost.

Note: All communications, notices and orders must be made on the URERA portal, ensuring transparency and a documented trail.

  • Improved urban planning as projects must conform to approved landuse policies.
  • Reduction in litigations, freeing up judicial resources.

While the Uttarakhand RE Act has already ushered in a new era of accountability, continuous refinement is essential:

  • Strengthen Enforcement Periodic audits of escrow accounts and surprise field inspections.
  • Incentivise Compliance Offer tax rebates or faster approvals for developers with a clean compliance record.
  • Capacity Building Conduct regular workshops for agents and developers on the Acts provisions.
  • Data Transparency Publish quarterly reports on project completions, dispute statistics and enforcement actions.

By embracing these measures, Uttarakhand can cement its reputation as a state where realestate investment is secure, transparent, and aligned with the aspirations of its citizens.
