The Department is committed to handling employee separations with professionalism, fairness, and compliance with all applicable laws and policies. Whether an employee is resigning, retiring, being transferred, or terminated, a consistent process helps protect the departments interests, ensures a smooth transition of duties, and upholds the dignity of the departing employee.
This page outlines the key principles, legal obligations, and practical steps that managers, HR staff, and employees should follow from the moment a separation is announced until the final exit interview.
Legal Requirements
All separations must comply with federal, state, and local regulations. The most common statutes affecting the process include:
- Fair Labor Standards Act (FLSA) final wages, accrued overtime, and proper recordkeeping.
- Family and Medical Leave Act (FMLA) protection for employees on leave who decide to resign.
- Uniformed Services Employment and Reemployment Rights Act (USERRA) reemployment rights for servicemember employees.
- Workers Compensation laws continuation of benefits where applicable.
- State unemployment insurance eligibility determination and proper reporting.
- Title VII, ADA, ADEA ensures that separations are nondiscriminatory and that reasonable accommodations have been considered.
HR must verify that all documentation (e.g., termination letters, exit interview notes) is retained for at least three years, as required by most regulations.
StepbyStep Process
1. Initiation
Separation may be initiated by the employee (resignation, retirement, voluntary transfer) or by the Department (termination, layoff, involuntary transfer). The initiating party must notify the employees direct supervisor and HR in writing.
2. Notification to HR
Within 24hours of receiving notice, the supervisor completes the Separation Initiation Form in the HRIS system. The form captures:
- Employee name, ID, and position
- Type of separation
- Effective date
- Reason (if applicable)
- Outstanding issues (e.g., equipment, projects)
3. Manager Review & Approval
The supervisor reviews the employees performance records, eligibility for rehire, and any contractual obligations. The manager then forwards the form to HR for final approval.
4. HR Processing
HR performs the following actions:
- Confirm final paycheck calculations, including unused vacation, sick leave, and any bonus prorations.
- Determine eligibility for benefits continuation (COBRA, health, retirement). Provide the required notices.
- Coordinate with IT to schedule revocation of system access.
- Prepare a separation packet (termination letter, benefits summary, exit interview schedule).
5. Asset Retrieval
All Department property must be returned before the employees last day. This typically includes:
- Laptop, tablet, or desktop computer
- Mobile devices and chargers
- Security badge and keys
- Company credit cards
A checklist (see below) helps the supervising manager confirm receipt.
6. Knowledge Transfer
Departing employees are asked to document ongoing projects, pending tasks, and critical contacts. The manager should schedule a handover meeting with the designated successor or interim staff.
7. Exit Interview
The HR representative conducts a confidential exit interview within the final week. Topics include:
- Reasons for leaving (voluntary separations)
- Feedback on workplace climate and policies
- Suggestions for improvement
- Clarification of benefits and final pay
Responses are recorded in the HRIS and used for trend analysis.
8. Final Day & Confirmation
On the employees last day, the manager confirms that:
- All assets have been returned and logged.
- System access is disabled.
- The employee has received the final paycheck and benefit notices.
A Separation Confirmation email is sent to the employee, the manager, and HR.
9. PostSeparation FollowUp
HR monitors any outstanding items for up to 30days, such as:
- Processing unemployment claims
- Resolving disputed final wages
- Providing references, if requested
