Landlords Notice to Terminate Early Residential Tenancies Act 2018

The Residential Tenancies Act 2018 (RTA) governs the rights and responsibilities of landlords and tenants in NewZealand. While a tenancy is normally a fixedterm agreement that continues for the period agreed upon, the Act also sets out specific circumstances where a landlord may give a tenant notice to terminate the tenancy early.

When Can a Landlord Terminate Early?

Under the RTA, a landlord may only end a tenancy before the agreedupon end date for the reasons listed in Tenancy Services. The most common grounds are:

  • Material breach the tenant has seriously failed to meet an obligation, such as nonpayment of rent for more than 14 days.
  • Sale of the property the landlord has entered into an agreement to sell the dwelling and the purchaser intends to reside in it.
  • Landlords own intention to occupy the landlord, a family member, or a close relative intends to live in the premises.
  • Landlords breach the landlord has materially breached the tenancy agreement (e.g., failing to maintain the property).
  • Other statutory reasons such as a court order or compulsory acquisition.

Notice Periods Required

The RTA imposes minimum notice periods which depend on the reason for termination:

Reason for Termination Minimum Notice Required
Material breach (rent arrears, damage, etc.) 14 days (if rent is unpaid) or 90 days for other breaches
Sale of property (new owner intends to occupy) 90 days
Landlord or family member intends to occupy 90 days
Landlords material breach of agreement 14 days
Court order / compulsory acquisition As specified by the order

Key Requirements for a Valid Notice

  1. Written Form The notice must be in writing and dated.
  2. Correct Content It must state:
    • The date the notice is given.
    • The date the tenancy will end (the termination date).
    • The specific ground for termination (e.g., sale of the property).
    • The landlords name, address, and signature.
  3. Delivery Method The notice can be handed to the tenant, left at the premises, or sent by post, email, or other agreed method.
  4. Compliance with Minimum Period The termination date must be at least the minimum number of days after the notice is served.
  5. Good Faith The landlord must act honestly and not use the termination right as a pretext for retaliation.

Tenant Rights and Options

Tenants are not powerless when faced with early termination:

  • Dispute the Notice If the notice is believed to be invalid (e.g., insufficient notice period), the tenant can apply to the Tenancy Tribunal.
  • Request Extended Notice In some cases, a tenant may negotiate a longer moveout period.
  • Seek Compensation If the landlord breaches the agreement, tenants may be entitled to compensation.

Common Mistakes Landlords Make

  1. Giving less than the statutory notice period.
  2. Failing to state the correct legal ground for termination.
  3. Using an informal method (e.g., a text message) without a written record.
  4. Attempting to terminate for a reason not permitted under the RTA.
