However, the effectiveness of these regimes is often hampered by issues of sovereignty, compliance, and enforcement.

International institutions often lack the "teeth" to compel action. Without a global sovereign to enforce rules, compliance relies heavily on reputational concerns, reciprocity, and domestic political pressure. The Kyoto Protocol and the Paris Agreement illustrate the evolution of these approaches, moving from rigid top-down targets to more flexible, pledge-and-review systems. While the latter may increase participation, the institutional challenge remains ensuring that these non-binding pledges translate into tangible domestic policy changes.

Adaptive Governance and Transformation

Given the uncertainty and non-linear nature of environmental change, static institutions are insufficient. The new focus for scholars and policymakers is "adaptive governance." This approach emphasizes flexibility, learning, and the capacity to reorganize as conditions change. It involves moving away from command-and-control regulation toward more collaborative, network-based governance that includes NGOs, scientists, and private sector actors.

Adaptive governance recognizes that we cannot manage environmental change with perfect knowledge; therefore, institutions must be designed to be resilient. They must monitor ecosystem feedbacks and adjust policies accordingly. This requires institutional arrangements that foster experimentation and allow for the scaling up of successful innovations. In some cases, however, adaptation is not enough, and institutions may need to undergo radical transformation to address the root causes of unsustainability.
