Equal Employment Opportunity Law

Overview

Equal Employment Opportunity (EEO) law is a body of federal statutes, regulations, and court decisions that prohibit discrimination in the workplace. Its purpose is to ensure that hiring, promotion, compensation, training, benefits, and termination decisions are based on merit and not on immutable characteristics such as race, gender, age, disability, or national origin.

In the United States, the primary agency responsible for enforcing EEO law is the Equal Employment Opportunity Commission (EEOC). The EEOC investigates complaints, mediates disputes, and pursues litigation when necessary. While the EEOC sets national standards, many states have their own antidiscrimination laws that may provide broader protections.

Protected Classes

Federal EEO statutes identify several protected classes. Discrimination against an individual because of any of the following characteristics is illegal:

  • Race and Color includes discrimination based on skin tone, hair texture, and facial features.
  • National Origin covers country of origin, ethnicity, accent, or ancestry.
  • Sex includes gender, gender identity, and sexual orientation (as recognized by recent Supreme Court rulings).
  • Age applies to workers 40 years and older.
  • Disability refers to a physical or mental impairment that substantially limits one or more major life activities.
  • Religion includes religious beliefs, practices, and observances.
  • Genetic Information information about an individuals DNA, family medical history, or results of genetic tests.
  • Civil Service Status protection for federal employees and applicants.

Many states also protect additional categories such as marital status, parental status, sexual orientation, gender expression, and more.

Key Legislation

Civil Rights Act of 1964 (Title VII)

Title VII is the cornerstone of modern EEO law. It prohibits employment discrimination on the basis of race, color, religion, sex, or national origin. The act applies to employers with 15 or more employees, as well as labor unions and employment agencies.

ADEA Age Discrimination in Employment Act (1967)

Protects workers 40 and older from agebased discrimination. It covers most employers with 20 or more employees.

ADA Americans with Disabilities Act (1990)

Title I of the ADA forbids discrimination against qualified individuals with disabilities and requires reasonable accommodations, unless doing so would cause undue hardship.

EEOC Enforcement Guidelines

The EEOC promulgates regulations that clarify how the statutes are applied in specific contexts, such as harassment, retaliation, and the use of background checks.

Recent Developments

Supreme Court decisions in the 2020s have expanded the definition of sex to include gender identity and sexual orientation, reinforcing that discrimination against LGBTQ+ individuals is prohibited under Title VII.

Enforcement Process

When an employee believes they have been discriminated against, the typical EEOC process follows these steps:

  1. Filing a Charge The complainant must file a charge with the EEOC within 180 days of the alleged discriminatory act (or up to 300 days if a state or local agency also has jurisdiction).
  2. Investigation An EEOC investigator gathers evidence, interviews parties, and may request documents.
  3. Mediation The EEOC offers voluntary mediation to resolve the dispute without litigation.
  4. Determination After investigation, the EEOC issues a righttosue letter if it finds insufficient evidence, or a notice of charge if it believes discrimination occurred.
  5. Litigation The EEOC may file a lawsuit on behalf of the employee, or the employee may file a private suit after receiving a righttosue notice.

Equal opportunity is not a privilege; it is a right that the law safeguards for every worker.

Employer Responsibilities

Employers must take proactive steps to prevent and address discrimination:

  • Policy Development Adopt clear antidiscrimination and antiharassment policies, distribute them to all employees, and require acknowledgment.
  • Training Provide regular training for managers and staff on recognizing and preventing bias, harassment, and retaliation.
  • Reasonable Accommodations Engage in an interactive process with employees with disabilities to determine feasible accommodations.
  • Recordkeeping Maintain personnel files, payroll records, and documentation of complaints for at least one year (or three years for certain data).
  • Retaliation Prohibition Never punish an employee for filing a charge, participating in an investigation, or otherwise exercising their rights.
  • Hiring Practices Use jobrelated criteria, avoid questions about protected characteristics, and conduct consistent assessments.

Failure to comply can result in costly settlements, backpay awards, punitive damages, and reputational harm.
